I discovered this being linked from gamespot.com
Somebody is not only selling BC, but is selling mods that WE made with it.
This is a total outrage! Is there anything we can do about this?
I realize that it says the mods are a FREE DVD bonus, but the fact remains that the person is selling this as a package. The additional mods are being used to attract customers and make the seller more money. Therefor they are profiting from our work.

I emailed the site. If it doesn't dissapear in a few days, someone remind me and I'll post their email on bcfiles news titled "mod theft" and let the entire community fill their inbox.

Everyone involved in the development of the KM mod (and any other mod included on the "bonus" DVD) should get together and do a massive class action lawsuit against these guys. Take em for all they got, thou with a name like AnimeFirst, it's not likely to be much :P

Hmmm odd. So Yahoo Commerce allows idiots of all sorts sell stuff eh? Where would he even be still getting legitimate copies of BC from after 6 years?? lol
I'm sure if someone told Raven about this, he'd sick his lawyers after them.
It also looks like the site may be shady....... selling bootleg copies, etc.. I think he may be selling burnt copies. If I had money spare, I'd probably order one just to see if it actually ships... and 2.... exactly what he is shipping.

i think it is a dirty move and a bit low on the seller's part, but they are not selling the modded DVD... they are using the "free" DVD as an incentive to sell the actual BC disc itself... anyone who is dumb enough to fall for it, clearly doesnt know about bcfiles lol
but in the end, there is nothing legally wrong with giving items to a buyer who is making a purchase...
if they were selling the mod DVD alone, of course that is entirely different... and, id they were selling the BC disc and the mod DVD as a "pack", that would be different also... but they do clearly say that the mod DVD is a free bonus and again legally there is nothing wrong with adding free items to a purchase...
however i do think it is a dirty move and they shouldnt be allowed to toss in any "free bonus" which others have made, but i think they are within their legal rights to do so...
of course, i am only assuming, and do hope i am absolutely wrong...

Unfortunately, they have the legal right to sell it that way.
However, I might note that they are only selling BC for $50 US, which is one of the lowest prices online!

Well it's off his site now in any case.
However, having familiarity with the anime community, some of the titles he's selling aren't valid for retail in North America due to various liscensing issues. The guy is obviously black market.
Now to report to yahoo..... :arms:

Ahhh. Well. They need to sell it. So they can be SUED.

They can be sued for copyright infringement. Fairly sure the modders involved that have stuff on that "FREE" DVD, didn't condone or allow the site owner to sell discs with a "bonus" disc containing their work.

darkthunder has a point. In the readme for KM it says:
5. You must contact us if you want to redistribute Kobayashi Maru, or any parts of it!
This is redistribution, thus they broke the licence/copyright thingy.

they are not marketing KM itself, they are selling the disc plus a free bonus... they are using KM as an incentive, but the focus of the sale is BC... as dirty as it is, they arent technically doing anything illegal or conducting any copyright infringements...
theyve found the "loophole" and are taking full advantage of it...

Theyre still redistributing it though, which is against the licence/copyright in the readme for KM.

Just because KM is free doesn't mean it doesn't have laws that can be broken.
The license/copyright in the ReadMe for KM must be considered.
This site broke that so it's an illegal spreading.

well, im not too sure about the whole redistributing thing... but anyone can grab KM off BCFiles for free...
if they sold the KM disc, of course that would be totally different... perhaps Defiant and the KM Team should intervene into this, i would be curious what to hear what the seller has to say...

Right, In order to claim mod theft, you would have to prove that part of the $49.99 revenue made was from the mod material included in the package. However, since they said it is FREE, this would be very difficult if not impossible to do.
However, you might have a case if they didn't credit the authors of the mods. Otherwise, they are legally entitled to do as they please.

It's possible they did make a request to distribute the mod through the Kobayashi Maru forum or directly through the author's email but did not receive an answer. I've requested to modify KM 1.0 similar to KM pimped and have gone unanswered. Perhaps a similar situation occurred with them. According to the license agreement of the KM team, they are able to distribute anything they want as long as proper credit is given.

It's just like copying retail DVDs. You can copy them for yourself, and give one out to your friend, and they can't get you. The second you give it out to your friend for money, they've got you.

:( Ah, the loopholes of the legal system. There ought to be something in the mod license agreement that states something to the effect of: "Any redistribution beyond www.bcfiles.com is strictly prohibited without the explicit consent of all the participants of the development of these mods" ...or something...
