Well, I assume that means they thought it was that damn good of a model.  You know.  Like you didn't already know that. :D

that looks like a solicitation cover, I can't imagine that they wouldn't have a professional artist to make renders for the final covers.  I'll bet that whoever threw that together just found it on google.

Apparently it's on the S&S website as well...Wiley I hope you at least give them permission to use it in your letter, as I think yours is much more accurate than the one they have been using lately :S

It's been over 2 days and no response from Simon and Schuster. I've just sent an email to the people(copyright section) on deviantart.

Just to play devil's advocate...ultimately the Sovereign Class belongs to CBS/Paramount/Viacom/Whoever the hell it is who owns Star Trek this week...since they've licensed S&S to produce Trek Books, would that mean that S&S then have the right to trawl the Internet for images of the Sovereign Class Ship, which they own?

Seems like this has the potential to be one of those very dicey areas of the law which the internet has turned 50,000 shades of grey...

well seeing as its Wiley's own homemade RE-creations of the sovereign class, it is technically his property under the copyright of DeviantArt as his Deviation and not CBS/Paramount/Whoever.

CBS has rights to the design, not to the composition of the render.

I got a response from deviantART, they say that no third party can make a profit from someone else's work without asking permission. They also said that I should go to a copyright attorney to additional advice.

I guess this is where I stop (it will get too expensive from then on). I'll probably post something on my deviantARTpage about it.

That's a little defeatest. Send more emails. Pester them. Threaten legal action (even if you have no intention of following through). Find a Cease and Desist letter template online and post one to them.

Or tweeting to the author of the book (my brother did) and getting a response: Thanks for bringing this to my attention. I've passed it on to my editors at S&S.

Good luck, and hopefully they'll either do one of two things...take your awesomeness off their book, or ask you to use your awesomeness and offer you a nice hunk of cash for every book sold :D

idk if they could do that. i think that depends on how liberal paramount was with the copyright allowance.

if they classified wiley as a third party artist i guess its possible  :idk:

Last week, I was contacted by the Associate Art Director at Simon and Schuster and they mistook my render as something from Paramount. They even offered me money for use of the picture. Me and the Associate Art Director are waiting on Simon & Schuster's Purchasing Department (payment maybe?).

In addition, they offered if they could use some of my other artwork in possible future projects. I responded asking if they could use me as a sub-contracted/freelance artist.

On another note, IDW has traced over some of my renders in their recent ST: TNG "Hive" comic series.

Super cool. Always a nice compliment, when they mistake fan artwork, for the "real deal" :)

Hope you get "hired" as a freelancer.
